Buyers and creditors beware: Axiom Worldwide has declared BANKRUPTCY April 1, 2010.

A Federal jury in Tampa Florida returns a verdict today in favor of Hako-Med finding that Axiom Worldwide willfully infringed Hako-Med's Horizontal Therapy patent and awarded damages.  In addition the federal court issued another permanent injunction against Axiom Worldwide barring all EPS 8000 devices manufactured prior to November 28th 2006.

Hako-Med in reaction to the courts decision will offer temporary amnesty from prosecution of physicians who are owners of a medical device suspected of infringement of any of Hako-Med's intellectual property or patented devices if said devices are traded in for a Hako-Med Horizontal Therapy System.

United State Magistrate Judge, Elizabeth A Jenkins, recommends that Hako-Med's motion for preliminary injunction be granted as to the VasoPulse® trademark infringement claim against Axiom Worldwide, Inc.

"Plaintiffs’ motion should be GRANTED and a preliminary injunction ISSUED as to Defendants’ use of the registered trademark VASOPULSE®, prohibiting Defendants from using the VASOPULSE® name, trademark, or logo in any manner on any of its products, marketing materials, advertising materials, manuals, or any other written materials describing their electrical nerve stimulation device."

Hako-Med has filed a patent infringement and trademark infringement lawsuit against Axiom Worldwide, Inc. in United States District Court, Middle District of Florida, Tampa Division on Wednesday the 27th of September 2006.

Hako-Med will vigorously pursue and prosecute to the fullest extent permitted by law any person or entity who has and or is infringing on Hako-Med intellectual property, who aids or has aided in infringing on Hako-Med's intellectual property, who sells or has sold Hako-Med’s intellectual property without Hako-Med’s express permission or who knowingly buys or has bought or who knowingly possesses Hako-Med intellectual property without the express permission of Hako-Med.
